RACC Giveaway Official Rules

These Official Rules govern the promotional giveaways (each, a “Giveaway”) offered by Real Autograph Collectors Club (“RACC,” the “Sponsor,” “we,” or “us”) at racctrusted.com. Each Giveaway also has a page that sets out that Giveaway’s specific details — its entry period, prize(s) and approximate retail value, eligible region, entry requirements, and number of winners (the “Giveaway Details”). The Giveaway Details are part of these Official Rules; if they conflict, the Giveaway Details control for that Giveaway. By entering, you agree to these Official Rules and the Sponsor’s decisions, which are final and binding. Each Giveaway is a game of chance.

1.Sponsor

The Sponsor of each Giveaway is Real Autograph Collectors Club, contactable at legal@raccweb.com. Where a Giveaway’s prize is supplied by a RACC Trusted Seller or other provider, that provider is identified on the Giveaway page; the Sponsor still administers the Giveaway under these Official Rules.

2.No platform association

Each Giveaway is solely sponsored by RACC. It is not sponsored, endorsed, administered by, or associated with Facebook/Meta, Instagram, Apple, Google, eBay, or any other platform, even where a Giveaway is promoted through them. By entering, you release those platforms from any and all liability relating to the Giveaway. Any questions must be directed to the Sponsor, not the platform.

3.No purchase necessary

No purchase or payment of any kind is necessary to enter or win, and a purchase or payment will not improve your chances of winning. Entry requirements consist of free actions (see Section 6), and a free alternate method of entry is available (see Section 7). Being a member of RACC is free; a paid Verified or Trusted Seller subscription is never required to enter a Giveaway.

4.Eligibility

Each Giveaway is open only to individuals who, at the time of entry, are:

• At least 18 years old (or the age of majority in their jurisdiction, if higher);
• Legal residents of, and located in, the eligible region stated on that Giveaway’s page (for example, the United States only, or a specified list of countries); and
• Holders of a RACC account in good standing who meet that Giveaway’s stated entry requirements.

Giveaways are void where prohibited or restricted by law. Employees, officers, and contractors of the Sponsor and of the prize provider, and their immediate family and household members, are not eligible. Entrants are responsible for ensuring that entry and acceptance of a prize are lawful where they live. Only one account and one entry per person are permitted per Giveaway unless a Giveaway’s page expressly states otherwise; using multiple or fake accounts voids all of your entries.

5.Giveaway period

Each Giveaway’s entry period opens and closes at the dates and times stated on its page (giveaway times are U.S. Eastern Time). Entries submitted before or after the stated period, or that are incomplete, are void. The Sponsor’s clock is the official timekeeper. Some Giveaways unlock or draw only when a stated entry target is reached, and may be extended or cancelled if it is not, as stated on the Giveaway page.

6.How to enter

During the entry period, sign in to your RACC account, visit the Giveaway page, complete that Giveaway’s stated free entry requirements (for example: being a verified member, meeting a minimum account age, adding a friend, or other free community actions), confirm your eligibility, agree to these Official Rules, and submit your entry. All entry requirements are free. Automated, scripted, or bulk entries, and entries made through any means other than as described here or in Section 7, are void.

7.Free alternate method of entry (AMOE)

You may enter any Giveaway free, without completing the on-site entry requirements, by mailing a postcard with your full name, the email address on your RACC account, your mailing address, your date of birth, and the exact title of the Giveaway you wish to enter to: RACC Giveaways — [mailing address to be provided], Connecticut, USA. Mail-in entries must be handwritten, limited to one per Giveaway per person, and received before that Giveaway’s stated close. Mail-in entrants must still meet all eligibility requirements. Each valid mail-in entry receives the same one entry as an on-site entry and the same chance of winning.

8.Winner selection & odds

Winner(s) are selected in a random drawing from all eligible, non-disqualified entries received for that Giveaway, conducted by the Sponsor (including by an automated random process) on or promptly after the close. The number of winners is stated on the Giveaway page. Your odds of winning depend on the total number of eligible entries received. The Sponsor’s selection is final.

9.Notification, claim & forfeiture

Potential winners are notified by email at the address on their RACC account and, unless a Giveaway states otherwise, must respond and claim within the stated window (for example, 48 hours). The Sponsor may require a potential winner to verify eligibility and to sign and return an affidavit of eligibility, a liability/publicity release, and (where required) a tax form before a prize is awarded. If a potential winner does not respond in time, declines, is ineligible, cannot be verified, fails to return required documents, or the notification is undeliverable, that person forfeits the prize and the Sponsor may draw an alternate winner or leave the prize unawarded.

10.Prizes, value & authenticity

The prize(s) and their approximate retail value (ARV) are described on each Giveaway page. Prizes are non-transferable, and no cash or other substitution is permitted except by the Sponsor, which may substitute a prize of equal or greater value if the advertised prize becomes unavailable. Any difference between the stated ARV and actual value is not awarded. Where a prize is an autograph or memorabilia, the provider (a RACC Trusted Seller or the Sponsor) is responsible for its authenticity and description, consistent with the RACC Seller Agreement; as elsewhere on RACC, the Sponsor makes no independent guarantee of authenticity, and winners are encouraged to verify with a legitimate third-party authenticator (BAS, PSA/DNA, JSA, ACOA, or others).

11.Taxes

Winners are solely responsible for all federal, state, and local taxes on a prize, and for any expenses not expressly listed as part of the prize. Where required by law (for example, in the U.S. for prizes with an ARV of US$600 or more), the Sponsor may report the prize to tax authorities and require a completed IRS Form W-9 or equivalent before delivering the prize; failure to provide required tax information forfeits the prize.

12.Shipping & fulfillment

The prize is delivered to the verified winner’s address by the Sponsor or by the prize provider, as indicated for that Giveaway. Risk of loss passes on shipment. The Sponsor and provider are not responsible for a prize lost, delayed, or damaged in transit once shipped, and if a prize cannot be delivered after reasonable attempts, it is forfeited. Winners are responsible for providing an accurate, deliverable address.

13.Publicity release

Except where prohibited by law, by accepting a prize a winner consents to the Sponsor’s use of their username, first name and last initial, city/state, and prize won for winner-announcement and promotional purposes in connection with RACC, without further notice, compensation, or additional consent.

14.Release & limitation of liability

By entering, you release and hold harmless the Sponsor, the prize provider, and their owners, officers, employees, and agents (the “Released Parties”) from any and all claims, injury, loss, or damage arising out of participation in any Giveaway or the acceptance, use, or misuse of any prize. The Released Parties are not responsible for late, lost, misdirected, incomplete, or garbled entries; technical, network, or website failures; or any error in the administration of a Giveaway. To the maximum extent permitted by law, the Released Parties’ total liability relating to any Giveaway will not exceed the ARV of the prize(s) for that Giveaway, and no Released Party is liable for indirect, incidental, special, consequential, or punitive damages. Some jurisdictions do not allow certain limitations, so parts of this may not apply to you.

15.Disqualification & conduct

The Sponsor may disqualify any entrant and void any entry it believes, in its sole discretion, has violated these Official Rules or the RACC Terms of Service; tampered with entry, drawing, or site systems; used bots, scripts, multiple or fake accounts, or automated means; or acted fraudulently or in bad faith. Attempting to undermine a Giveaway may violate law, and the Sponsor reserves the right to seek remedies.

16.Sponsor’s rights

The Sponsor may, in its sole discretion and to the extent permitted by law, modify, suspend, extend, cancel, or terminate any Giveaway — for example, if fraud, technical failure, insufficient entries, or any factor beyond its reasonable control corrupts or affects the administration, security, fairness, or proper conduct of the Giveaway. The Sponsor’s failure to enforce a term is not a waiver of it.

17.Disputes, governing law & arbitration

These Official Rules are governed by the laws of the State of Connecticut and, where applicable, the Federal Arbitration Act, without regard to conflict-of-laws rules. Except where prohibited, any dispute relating to a Giveaway will be resolved by final and binding individual arbitration and not in court, and you waive any right to a jury trial and to participate in a class, collective, or representative proceeding, on the same terms and with the same 30-day opt-out set out in the RACC Buyer & Community Agreement. Any permitted court action will be brought exclusively in the state or federal courts located in Connecticut, USA.

18.Privacy

Information you provide to enter is used to administer the Giveaway, verify eligibility, and award prizes, and is otherwise handled as described in our Privacy Policy.

19.Winners list

Winners are announced on the applicable Giveaway’s page. To request the name of a winner for a specific Giveaway, email legal@raccweb.com with the Giveaway title within 60 days after it closes.

20.General

If any provision of these Official Rules is held unenforceable, the rest remain in effect. These Official Rules, together with the applicable Giveaway Details and the RACC Terms of Service, are the entire agreement between you and the Sponsor regarding a Giveaway. The Sponsor is not responsible for typographical or other errors in the offer or administration of a Giveaway, including errors in the identification of an entrant or winner or the announcement of a prize or its value.
